Hummingbird Villa - Short-Term Rental Agreement

HUMMINGBIRD VILLA – SHORT-TERM RENTAL AGREEMENT

Property: Hummingbird Villa, Lot 13, Mount Standfast Park, St. James, Barbados
Owner: CAS Property Inc.

This Short-Term Rental Agreement ("Agreement") is made between CAS Property Inc. ("Owner") and the undersigned guest ("Guest"). By signing this Agreement, the Guest accepts the terms below for their stay at Hummingbird Villa.

1. Booking Platform Terms

This Agreement governs the Guest's conduct and use of the property during their stay. Payment terms, cancellation rules, refund conditions, and platform fees are governed exclusively by the terms of the platform through which the reservation was made (Booking.com, Vrbo, Airbnb, or direct website). This Agreement does not modify, override, or replace those platform-specific terms.

2. Temporary License – No Tenancy Created

This Agreement grants the Guest a temporary, revocable license to occupy the property solely for the dates specified in the booking confirmation. This is NOT a lease or tenancy agreement. The Guest acknowledges that:

  • No landlord-tenant relationship is created.
  • The Guest has no right to remain at the property beyond the checkout date and time specified in the booking.
  • The Guest acquires no possessory rights, tenancy rights, or any claim to the property.
  • Occupancy beyond the authorized dates constitutes trespassing and the Owner may take immediate legal action or other lawful steps for removal.
  • This license may be terminated immediately if the Guest violates any terms of this Agreement.

3. Rental Period & Occupancy

  • Check-in: 4:00 PM
  • Check-out: 11:00 AM
  • Maximum overnight occupancy: 6 registered guests

Guest agrees to provide accurate details of all staying guests prior to arrival. Visitors are welcome during the day, but all overnight guests must be registered and the maximum occupancy must not be exceeded.

4. Use of the Property

The Guest agrees that:

  • The villa is for private vacation use only.
  • No events, parties, or commercial activities are permitted.
  • The Guest will maintain the property in a clean and respectful condition.
  • Children must be supervised at all times.
  • No pets are allowed.
  • Smoking is not permitted indoors. Smoking outdoors is allowed but cigarette waste must be disposed of responsibly.
  • Subletting or transferring the booking to another party is not allowed.
  • Illegal drugs, weapons, firearms, and fireworks are strictly prohibited.
  • Open flames including candles are not permitted inside the villa.

5. Pool Safety

The Owner has taken reasonable precautions to ensure pool safety, including the installation of handrails, safety signage, and a flotation ring. However, the pool is not supervised by a lifeguard, and Guests use the pool entirely at their own risk. Children must be supervised at all times when near or in the pool area.

To the fullest extent permitted by Barbados law, the Owner disclaims civil liability for accidents or injuries arising from the use of the pool or pool area, except where caused by the Owner's proven gross negligence or wilful misconduct.

6. Keys & Property Access

Keys to the villa are kept in a secure lockbox. Guests will be provided with the access code prior to arrival. At checkout, all keys must be returned to the lockbox. Lost or unreturned keys will incur a replacement fee of USD $100, reflecting the reasonable cost of replacement. Lost or unreturned gate fobs will incur a replacement fee of USD $100, reflecting the reasonable cost of replacement.

7. Noise & Neighbour Respect

Quiet hours are 10:00 PM to 6:00 AM. The Guest agrees to respect neighbours and refrain from excessive noise or disturbances.

8. Property Access for Emergencies

The Owner, or a representative acting on its behalf, may enter the property in the event of emergencies. Examples of emergencies include water or gas leaks, electrical hazards, structural damage posing safety risk, or security breaches. Guests will be informed as soon as reasonably possible. For non-emergency maintenance, the Owner will always request consent before entering.

9. Damage and Guest Responsibility

While we endeavour to ensure the property is in excellent condition, we ask guests to please report any existing damage as soon as possible upon arrival.

The Guest agrees to:

  • Report any damage or malfunction promptly.
  • Be financially responsible for any damage caused by the Guest or their visitors beyond normal wear and tear.
  • Allow the Owner to recover costs consistent with the policies of the booking platform or via third-party verification services used by the Owner (e.g., Truvi).

10. Early Departure

No refunds will be provided for early departure or unused nights, except as required by the booking platform's policies.

11. Right to Terminate Stay

The Owner reserves the right to immediately terminate the Guest's stay without refund in the event of:

  • Violation of quiet hours or excessive noise complaints
  • Illegal activity on the premises
  • Property damage or misuse
  • Exceeding maximum occupancy limits
  • Violation of any other material term of this Agreement

12. Security Cameras

Security cameras are installed around the exterior perimeter of the villa for safety and security. These cameras record video only. No cameras or recording devices are located inside the villa or in the pool area.

13. Support & Emergencies

Guests may contact the Owner via the platform where they booked. In case of a major emergency (plumbing, electrical, safety), emergency contact information is provided in the villa.

14. Liability & Assumption of Risk

The Guest acknowledges that use of the villa involves inherent risks.

To the fullest extent permitted by Barbados law:

  • The Owner is not liable for accidents, injuries, illnesses, theft, or loss of personal belongings during the stay.
  • The Guest is responsible for ensuring their own travel, medical, and personal property insurance coverage.
  • The pool, garden, steps, and outdoor areas must be used responsibly and with caution.

Nothing in this Agreement shall exclude or limit the Owner's liability for death or personal injury arising from the Owner's proven gross negligence or wilful misconduct.

15. Legal Jurisdiction

This Agreement is governed exclusively by the laws of Barbados. Any disputes shall be resolved through the courts of Barbados.

16. No Third-Party Rights

This Agreement is solely between the Owner and the Guest who signs below. No third party (including other guests, visitors, or family members) has any rights under this Agreement or may enforce any terms against the Owner. This clause does not affect any third party's right to bring claims in tort under Barbados law.

17. Entire Agreement

This Agreement, together with the booking platform's terms, constitutes the full understanding between the parties. If any clause is found invalid under Barbados law, the remaining clauses remain in effect.

Guest Confirmation

By signing below, the Guest acknowledges that they:

  • Have read and understood this Rental Agreement
  • Agree to abide by all terms during their stay
  • Understand that booking platform rules continue to apply
