This Short-Term Rental Agreement ("Agreement") is made between CAS Property Inc. ("Owner") and the undersigned guest ("Guest"). By signing this Agreement, the Guest accepts the terms below for their stay at Hummingbird Villa.
This Agreement governs the Guest's conduct and use of the property during their stay. Payment terms, cancellation rules, refund conditions, and platform fees are governed exclusively by the terms of the platform through which the reservation was made (Booking.com, Vrbo, Airbnb, or direct website). This Agreement does not modify, override, or replace those platform-specific terms.
This Agreement grants the Guest a temporary, revocable license to occupy the property solely for the dates specified in the booking confirmation. This is NOT a lease or tenancy agreement. The Guest acknowledges that:
Guest agrees to provide accurate details of all staying guests prior to arrival. Visitors are welcome during the day, but all overnight guests must be registered and the maximum occupancy must not be exceeded.
The Guest agrees that:
The Owner has taken reasonable precautions to ensure pool safety, including the installation of handrails, safety signage, and a flotation ring. However, the pool is not supervised by a lifeguard, and Guests use the pool entirely at their own risk. Children must be supervised at all times when near or in the pool area.
To the fullest extent permitted by Barbados law, the Owner disclaims civil liability for accidents or injuries arising from the use of the pool or pool area, except where caused by the Owner's proven gross negligence or wilful misconduct.
Keys to the villa are kept in a secure lockbox. Guests will be provided with the access code prior to arrival. At checkout, all keys must be returned to the lockbox. Lost or unreturned keys will incur a replacement fee of USD $100, reflecting the reasonable cost of replacement. Lost or unreturned gate fobs will incur a replacement fee of USD $100, reflecting the reasonable cost of replacement.
Quiet hours are 10:00 PM to 6:00 AM. The Guest agrees to respect neighbours and refrain from excessive noise or disturbances.
The Owner, or a representative acting on its behalf, may enter the property in the event of emergencies. Examples of emergencies include water or gas leaks, electrical hazards, structural damage posing safety risk, or security breaches. Guests will be informed as soon as reasonably possible. For non-emergency maintenance, the Owner will always request consent before entering.
While we endeavour to ensure the property is in excellent condition, we ask guests to please report any existing damage as soon as possible upon arrival.
The Guest agrees to:
No refunds will be provided for early departure or unused nights, except as required by the booking platform's policies.
The Owner reserves the right to immediately terminate the Guest's stay without refund in the event of:
Security cameras are installed around the exterior perimeter of the villa for safety and security. These cameras record video only. No cameras or recording devices are located inside the villa or in the pool area.
Guests may contact the Owner via the platform where they booked. In case of a major emergency (plumbing, electrical, safety), emergency contact information is provided in the villa.
The Guest acknowledges that use of the villa involves inherent risks.
To the fullest extent permitted by Barbados law:
Nothing in this Agreement shall exclude or limit the Owner's liability for death or personal injury arising from the Owner's proven gross negligence or wilful misconduct.
This Agreement is governed exclusively by the laws of Barbados. Any disputes shall be resolved through the courts of Barbados.
This Agreement is solely between the Owner and the Guest who signs below. No third party (including other guests, visitors, or family members) has any rights under this Agreement or may enforce any terms against the Owner. This clause does not affect any third party's right to bring claims in tort under Barbados law.
This Agreement, together with the booking platform's terms, constitutes the full understanding between the parties. If any clause is found invalid under Barbados law, the remaining clauses remain in effect.
